E2 Visa: Treaty Investor for Non-Immigrants

What is E2 Visa

The E2 Visa is a non-immigrant visa that allows nationals of treaty countries to enter and work in the United States based on a substantial investment they have made or are actively in the process of making in a U.S. business. It is designed to promote economic investment and trade between the U.S. and countries with which it maintains a treaty of commerce and navigation.

E2 Visa Requirements

To qualify for an E2 Visa, the applicant must:

  • Be a citizen of a treaty country.

  • Make a substantial investment in a real and operating U.S. business.

  • Enter the U.S. to develop and direct the business (typically shown through ownership of at least 50% or possession of operational control).

  • Ensure the investment is at risk and not marginal (the business must generate more than just a living wage).

  • Demonstrate that the funds have been lawfully acquired.

E2 Visa Process

The E2 visa process typically includes the following steps:

  1. Create or invest in a U.S. business.

  2. Prepare documentation showing business ownership, financial investment, and treaty eligibility.

  3. File Form DS-160 and pay the visa fee.

  4. Submit supporting documents to the U.S. Embassy or Consulate in your country.

  5. Attend a visa interview where you must demonstrate the purpose and legitimacy of your investment.

  6. Wait for approval; once granted, you can enter and work in the U.S. under the terms of the visa.

F2B Visa Processing Time

The F2B Visa is for unmarried adult children (21 years or older) of U.S. lawful permanent residents (Green Card holders). As a family-preference visa, it is subject to annual caps and a priority date system.

Processing time can range from 5 to 10 years or more, depending on:

  • The applicant’s country of origin (some countries have longer backlogs).

  • The number of applicants in the queue.

  • The current Visa Bulletin issued monthly by the U.S. Department of State.
