What Are the Requirements for a K-1 Fiancé Visa?

To qualify for a K-1 fiancé visa, both the U.S. citizen petitioner and their foreign fiancé(e) must meet several eligibility requirements set by U.S. Citizenship and Immigration Services (USCIS) and the Department of State.

Requirements for a K-1 Fiancé Visa

Below are the main requirements:

1. U.S. Citizenship

  • The petitioner must be a U.S. citizen (not just a green card holder).

2. Intention to Marry

  • Both parties must have a genuine intention to marry each other within 90 days of the fiancé(e) entering the U.S.

3. Legal Ability to Marry

  • Both individuals must be legally free to marry (i.e., single, divorced, or widowed).
  • All previous marriages must be legally terminated before applying.

4. In-Person Meeting Requirement

  • The couple must have met in person at least once within the past two years before filing Form I-129F, unless a waiver is granted for cultural or religious reasons.

5. Proof of Genuine Relationship

  • Evidence must be provided to show the relationship is real, such as:
    • Photos together
    • Travel itineraries
    • Chat logs or call history
    • Affidavits from friends and family

6. Financial Requirement

  • The U.S. citizen must meet the minimum income requirement (typically 100% of the Federal Poverty Guidelines) to financially support the fiancé(e).
  • Form I-134 (Affidavit of Support) is required later in the process.

7. Background Checks

  • Both parties must undergo security screenings, and the foreign fiancé(e) must attend a medical examination and visa interview at a U.S. embassy or consulate.

8. Eligible Age

  • Both parties must generally be at least 18 years old (though the age of consent to marry can vary by state).

Meeting these requirements is essential for approval. Incomplete or inaccurate submissions can lead to delays or denials.
