Who Qualifies for VAWA?
VAWA (Violence Against Women Act) provides immigration protections for certain individuals who have been abused by a U.S. citizen or lawful permanent resident (LPR) family member. Specifically, those who qualify for VAWA self-petition include:
- Spouses: of U.S. citizens or LPRs who have experienced battery or extreme cruelty.
- Children: (unmarried and under 21) of U.S. citizens or LPRs who have been subjected to abuse.
- Parents of U.S. citizens who have been victims of battery or extreme cruelty.

The abuse can be physical, emotional, or psychological, and the qualifying relative must be the abuser. Importantly, VAWA allows eligible individuals to apply for immigration relief independently, without the abuser’s knowledge or consent, to help protect victims of domestic violence and ensure their safety.
